CDL Self-Certification
Interstate Commerce: When a driver operates a CMV in trade, traffic, or transportation:
- From one state to another state or a foreign country.
- Between two places within a state, but during part of the trip, the CMV crosses into another state or foreign country.
- Between two places within a state, but the cargo is part of a trip that began or will end in another state or foreign country.
Intrastate Commerce: When a driver operates a CMV and does not meet any of the descriptions for interstate commerce.
Once a driver determines if he or she will operate in interstate commerce or intrastate commerce, he or she must decide whether or not he or she operates (or expects to operate) in a non-excepted or excepted status. This decision will determine which of the four types of commerce the driver must self-certify.
NON-EXCEPTED INTERSTATE COMMERCE
- Driver drives interstate or intrastate commerce and holds a commercial driver license. (This includes drivers that are not currently operating a commercial motor vehicle.)
- Must have a valid DOT card.
- Driver must be at least 21 years old.
Note: Selecting this category gives you the opportunity to operate in any type of commerce without driving type restrictions. A valid DOT certificate is required to maintain this category. Both your DOT expiration and the date you certified to this type of operation will show on a CDL Motor Vehicle Report (MVR).
EXCEPTED INTERSTATE COMMERCE
Driver currently drives interstate only under excepted transportation or operations as described in 49 CFR 390.6(f), 391.2, 391.68, 398.3.
- Transportation of school children and/or school staff between home and school.
- Transportation performed by a Federal, State, or local government employee.
- Occasional transportation of personal property by individuals not for compensation and not in the furtherance of commercial enterprise.
- Transportation of human corpses or sick and injured individuals.
- Operation of fire trucks and rescue vehicles during emergency or other related activities.
- Operation of CMV's designed or used to transport between 9 and 15 passengers (including the driver), not for direct compensation, provided the vehicle does not otherwise meet the definition of a CMV.
- Operation of a CMV primarily for transportation of propane winter heating fuel when responding to an emergency condition requiring immediate response, such as damage to a propane gas system after a storm or flooding.
- Operation of a CMV in response to a pipeline emergency condition requiring immediate response, such as a pipeline leak or rupture.
- Operation of a farm vehicle that is not considered a combination vehicle (power unit and towed unit) and is used to transport.
- Agricultural products, farm machinery, or farm supplies (no placardable hazardous materials) to and from a farm and within 150 air miles of the farm.
- Operation of a CMV in custom harvesting on a farm or to transport farm machinery and supplies used in the custom harvesting operation to and from a farm.
- Transportation of custom-harvested crops to storage or market.
- Operation of a CMV by a beekeeper in the seasonal transportation of bees.
- Private motor carrier of passengers for non-business purposes.
- Transportation of migrant workers.
Driver must be at least 21 years old.
Note: Selecting this category allows you to operate in both interstate and intrastate. However, it restricts your CDL to only operating under the excepted activities listed in this section.
This driving type doesn't require you to submit a DOT certificate to your licensing jurisdiction. If the company you work for requires you to obtain a DOT certificate, you may want to select "Non-Excepted Interstate" so your CDL is not restricted to only the driving activities listed here.
Only the date you certified to this type of operation will show on a CDL Motor Vehicle Report (MVR). If you turn in a DOT certificate, the information WILL NOT show on the MVR until you certify to a different category.
NON-EXCEPTED INTRASTATE COMMERCE
- Driver has a federally disqualifying medical condition.
- Must be accompanied by a Utah intrastate waiver card.
- The driver does not meet the guidelines to obtain a valid DOT medical card under 49 CFR part 391.
- Must obtain a state DOT certificate marked for accompanied by a waiver/exemption.
- Must complete any medical reports required by the Driver License Division.
- Must obtain a K restriction on the license and may only drive intrastate commerce.
Note: This category is only used when you have a federally disqualifying medical condition and have been approved or currently in the application process to obtain a state waiver.
This driving type requires a DOT certificate marked for "State Operation" with the "Accompanied by a ______ waiver/exemption" restriction.
Both your DOT expiration and the date you certified to this type of operation will show on a CDL Motor Vehicle Report (MVR).

EXCEPTED INTRASTATE COMMERCE
- Driver is under 21 years old.
- Has a valid DOT medical card.
- Must have a K restriction added to the license.
- Not eligible to drive interstate because they are under age 21.
Note: This category is only used for those under the age of 21. Your driving type will be restricted to ONLY Intrastate Operations within the state of Utah and will require you to maintain the K-restriction on your license until your 21st birthday.
This driving type requires a DOT certificate that can be marked for either "Federal" or "State" operation.
Both your DOT expiration and the date you certified to this type of operation will show on a CDL Motor Vehicle Report (MVR).
After you turn 21 years of age, you will be required to certify under a different driving type and remove the K-restriction off of the license (unless required to certify as Non-Excepted Intrastate.)
