Interdicted Person

Effective January 1, 2026, HB 437 gives courts the authority to designate certain individuals convicted of DUI (Driving Under the Influence) as “interdicted persons.”  Once designated, those individuals are restricted from purchasing alcoholic beverages for a specified period.  It also requires special identification and labels for interdicted persons to be placed on the driver license (DL) or identification card (IDC).

Designation as an interdicted person: A court may (and in some cases must) designate a person convicted of DUI as an interdicted person.  Extreme DUI convictions must be designated as interdicted. 

Alcohol purchase prohibited: Once designated, the interdicted person is prohibited from purchasing alcoholic beverages during the interdiction period. 

Surrender/Reissue of driver license or identification card: The individual must surrender their current driver license or IDC to the court, and may apply for a special interdicted license or identification card.

Indicator on driver license or identification card: The interdicted DL/IDC will carry a red banner denoting "NO ALCOHOL SALE" to alert alcohol vendors that the person is interdicted.

Voluntary participationA person may voluntarily apply for an interdicted DL/IDC.  They will need to apply for a renewal or duplicate license or ID card and complete the interdicted person agreement form.  The interdicted DL/IDC will need to be maintained for 30 days before reapplying for a non-interdicted DL/IDC.

Court order:  If a court designates an individual as an interdicted person, the person may apply for a license or ID card to add the interdicted status by appearing in a DLD office.  The person will need to apply for a license or ID card; there will be an additional $7.00 administrative fee.  The courts have discretion to determine the length, which depends on the severity of the offense and court findings.
