Moped

This is a motorcycle that:

• Has pedals that permit human propulsion and a motor that produces not more than two brake horsepower.
• The motor cannot propel the cycle at a speed over 30 MPH on level ground.
• If an internal combustion engine is used, the displacement may not exceed 50 cubic centimeters.
• Must have a power drive system that functions directly or automatically without clutching or shifting by the rider after the drive system is engaged.
• Cannot operate on sidewalks or public roads with four or more lanes designated for regular traffic.
• Should ride close to the right side of the roadway.

A moped does not include a:

• Motor-assisted scooter
• Electric-assisted bicycle
• E-mobility device
